Writing an Effective Letter of Eviction
Has your tenant stopped paying rent? Maybe they have been late every month and you are just tired of. Alternatively, maybe they have violated a different part of your lease and you need to inform them that you are going to evict them. What are some key points to writing an effective eviction letter?
- Get your facts together when writing a letter of eviction. Do not use heresy or rumors. Make sure you can document your fact. If you are evicting your tenant for non-payment of rent, that will be much easier than if you are evicting for another lease violation. Facts gathered from neutral 3rd parties such as the police or neighbors have more weight in court than yours, since you are party to the eviction.
- In the tenant eviction letter, state the exact part of the lease that the tenant has broken. Again, be as specific as possible. Make sure the prohibited behavior is actually in the lease. If you are trying to evict for having a pet, make sure you lease prohibits pets.
- If it applies, specify how the tenant can cure the problem to cancel the eviction. If they owe you past due rent, explain that if they pay everything in full including the court costs, that you will dismiss the eviction. Give them a chance to be successful and solve the problem.
- If applicable, be specific on when the behavior change needs to occur by. Many landlords make the mistake of not drawing a line in the sand and being firm on what needs to change and by when. If they don’t change, it is easier to justify having to evict them.
Writing a good letter of eviction can make the process of managing tenants much easier. If you are firm, but authentic and honest, this will go a long way to winning your eviction cases if you can show that you did everything possible to help the tenant succeed.
